Legal Question in Family Law in New Jersey

Power of Attorney

My husband suffered a stroke in February and has been hospitalized ever since. While he is conscious, I have been the one making decisions regarding his medical care, etc. He is in physical therapy, and has been showing slight improvement in certain areas. He will be discharged in a few weeks. I have been looking into refinancing our home, taking advantage of the low interest rates, and have been told I will require a Power of Attorney for this transaction, and should alos have it to continue making the necesaary medical decisions for my husband. As our financial situation is suffering right now becuase my husband is taking Family Leave without pay, we do not have a lot of money for an attorney to draw up the Power of Attorney. Do I require an attorney for this procedure or can I do this on my own and have it notarized?

Thank you for your time.

Sincerely,

Re: Power of Attorney

You need a power of attorney that will be acceptable to the bank, the hospital, the lender who will all hold it to a high standard in order to protect themselves against any claim that you power of attorney is defective. You need ten copies, each bearing original signatures of your husband and the notary and all bear the notary seal impression. Each transaction will require an original poweer of attorney.

From your zip code I expect that you live far from Hackensack where I have my office. My fee for preparing the aforementioned documents would be $200.00. You would have to take a notary to your husband fully executed the ten original documents for this fee.

My telephone number is 800 273 7933. You can probably find the same fee in your area.
