Does a privte custody agreement dated and notarized before the dyfs took custody have ANY validity in court

It depends on what is going on.

When DYFS ( now called Department of Child Protection And Permanency, DCPP) takes custody, then you must go to court and respond to the lawsuit that DYFS filed.

As part of what you are going to tell the Judge, you may be able to show that there is an agreement that the abusive parent is NOT going to have custody or care of the children.
