Property

Can an ex wife sell a home and property without the ex husband signing off the contract? If so is she entitled to all the proceeds? Second when does child support end if not stipulated in the divorce decree?

Regarding the issue regarding the selling of marital (or former) property, I would need to see the language contained in your final divorce decree. I would also need to know whether that party is still on the Deed.

Regarding emancipation of children, ifthe divorce decree does not discuss this issue, then we need to turn to the relevant case law here in New Jersey.

"Emancipation" is not defined by age, it is defined by status. Thus, if the child is still in school at age 25, he/she may not be emancipated. On the other hand, a child who is married at age 17 would be emancipated. A careful review of all of the facts and circumstances is necessary. Similarly, I cannot answer your question about the property without reviewing the deed. Keep in mind that this advice is based purely on the little bit of information that you have given to me.
