Legal Question in Family Law in New Jersey

I have a step son that his real father has not come around in over a year, and i want to have his name changed to mine. Do i need to have his real father sign anything so he can have his name changed? Also there was never and custody battle he just kinda diapered. What can i do?

Also we now live in NJ and he lives in PA if it makes any difference.

The child's mother can change the child's name.
