Legal Question in Family Law in New Jersey

taking new wife's income into consideration

Please advise the circumstances which allow a new wife's income to be taken into consideration regarding child support.

Background: Judge ten years ago allowed new wife's income to be added to ex-husband's when considering child support, something about considering her a party.

Also, if ex is hiding income through a corporation, how do you find it? What do you do when everything is in ex-wife's name?

Thanks.

Re: taking new wife's income into consideration for child support

This is a very unusual circumstance. Apparently, the circumstances have already occurred if a Judge took the wife's income into consideration in making a prior determination. I get the feeling that your first question is related to your second one - i.e., is the husband working for a company owned by his wife and the wife is drawing a disproportionate share of the income, when compared to the husband's work time? Bottom line - a careful analysis needs to be given of your circumstances before any opinion can be given. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
