Legal Question in Family Law in New Jersey

temporary restraining order

my wife was recently found guilty of assaulting me and burning my face with a cigarette while driving a car with my two children in the back seat. she was put on probation and ordered to undergo anger management classes. six weeks later while i was at work she went to court and said i threatened her when i returned from work i was ordered to leave my home. i was not arrested nor charged with any crime. this is not the first time my wife has falsely accused me of these charges how come the judge never takes this into consideration . I would also like to know what my options are i have three children ages 17,5,and3. Thank you for help.

Re: temporary restraining order

You must fight the restraining order and, possibly, file for a restraining order against her. The children, and who cares for them, are a very important issue at this time. You must contact an attorney to advise you of your specific rights in this case.

Re: temporary restraining order

You should hire an attorney to fight the restraining order. However, how was she allowed in the house for her assault, didn't you have a restraining order against her?

I would be happy to follow up with you. Please email me directly or call my office if you would like to schedule an appointment either in person or by telephone. My contact information is listed in the links below.

Re: temporary restraining order

You really have only one option: fight the restraining order with everything you have. I would strongly advise getting an attorney. An FRO is one of the most serious penalties that can happen to a person without a jury deciding the case.
