Legal Question in Civil Litigation in New Jersey

Day 1 - I returned a rented car before the end of the business day. Handed keys over, car was inspected and contract was closed out. The car was left in front of the building overnight.

Day 2 - Rental agent called claiming there were damages to the hood of the trunk.

We went down to see damages but the car was not there and no pictures to support claim. We were told the damages were not visible, unless you look at an angle. After the meeting and several calls, they proposed we pay $900 in damages. Since the account was closed out in good standing, no car was there to verify damages and no pictures, I declined to agree.

Day 5 - A demand letter was sent in the amount $1300 requesting payment in 7 days

Day 8 - $500 unauthorized charge was made against my account; an investigation was with bank (amount revised). A civil lawsuit was filed for $522 by rental company.

I am I liable for damages and can I counter suit?

There defeinately appears to be a question about your liability which you should defend. You can also countersue for the return of the $500 taken from your account.
