Duty to maintain water heater so not to damage neighbor�s property (tort)

I live in a condominium in NJ. My upstairs neighbor's water heater broke and flooded my unit, causing water damage.

If my neighbor was not actively working on the water heater at the time when it broke, does he still have a duty to me? I would appreciate an opinion and any relevant citation.

Your neigbor owes a duty to not cause damage to his neighbor's apartment and is liable for the damages which you have suffered..
