Legal Question in Immigration Law in New Jersey

My brother have a little problem. I'm getting marry in my country in I want my brother to be there. He have probation and I'm afraid that he get in trouble if he fly out of the country. I have already talk to his provisional officer in his ok that it's ok by his side. He told me that he doesn't know if my brother may be stop on his way back to the country by immigration..... His provisional officer told me that he will give him a permission letter, but he say that he doesn't know if that is enought.

Despite what his probation officer says, I would strongly advice your brother not to travel outside of the U.S. until he is no longer on probation.

Yes, he might have a problem being admitted back to USA. Before he makes any international travel plans, he shall consult a knowledgeable immigration attorney. His probation officer can't advise him on his immigration status and rights.

What is your brother's status in USA: permanent resident, non-immigrant visa, etc? Only if he is a USA citizen, he will be always readmitted back to USA. Others may face different kinds of issues depending on inadmissibility grounds. What he was convicted for, what was his sentence. etc?
