i just found out i cant not adjust my status, im on a c1/d visa, and as i read here, i have to go back to my home country and get a k_3 visa,,

im here 5 months, and im thinking going back as soon as posible, before be here 6 months,, my question is? if i leave the country before the six months,, there is any penalty ,or how long it will take for me to get the k-3 visa and come back again to be with my wife?

The answer to your question depend on the country that you are from. Each consulate has different wait times. Are you already married? If so, you may want to consider filing an immediate relative petition instead of the K-3 visa. There are pros and cons to each visa, and you should speak with an immigration attorney to determine what the right visa is for you.
