Legal Question in Immigration Law in New Jersey

Fiancee Travelling between Poland and USA

I met my fiance while she was in the USA on a tourist visa. I believe she was here for 6 months on that visa, then had it extended, then had it changed to a student visa. After going to school for a few months, she decided she wanted to go back to college in Poland. My fiance is from Poland, and is currently living there now. She is going to college, and would like to finish her degree there. In January, she applied for another tourist visa so that she could visit, but she was denied. I have visited her in May, December, and plan on going again soon. I am looking for advice on the best way for her to be able to travel between the US and Poland, as well as continue her classes in Poland. I think she has about 3 years left. I understand a little about the fiance visa, but Im not sure what the next step would be, once we are married. Im not sure of the conditions/requirements for this visa, and how she should change her status once we are married. Also, one of my concerns is I understand they will evaluate us to determine if we have a bonified marriage. Im not sure what they would tell us if she is living in Poland, and I am in the USA until she finishes her degree. Thank you for any guidance you could provide.

Re: Fiancee Travelling between Poland and USA

You do have some options available that should be discussed in detail with immigration counsel. I would be happy to discuss the advantages/disadvantages of marriage vs. a fiance visa petition. We also have a paralegal who is a native of Poland and speaks fluent Polish.
