Legal Question in Immigration Law in New Jersey

Hello,

This is in regard to H1 B layoff. I'm here on a H1 B visa, (1 year so far) and I got laid off yesterday. I got a day's notice with a severance package. I have a few companies who has expressed interest in me. Since this happend very suddenly, I'm a bit worried about going out of status. How much time do i have to search for other opportunities, or wrap up my affairs.

Also, do I qualify for H1B portability with a new employer?

Hi,

There is a 10-day grace period after termination of employment to either change status to another nonimmigrant visa category (such as B2 visitor) or to file an H1B petition through another employer. Information about B2 status is here: http://h1b1.com/b1-b2visa.htm

H1B portability is not applicable as your employment has already been terminated. However, there is the option to file H1B petition through premium processing.
