Liability for Auto Damage

My brother was on his girlfriend's auto insurance policy and had an accident where he was found liable. The insurance company paid $5k in damages to the other party. The other party wants an additional $7k for damages, subequently my brother has passed away. Is his girlfriend now liable for the addtional $7k?

Your question raises other questions which need to be answered in order to adequately respond to you. You say that your brother was "found liable." Was that after a trial or was that a determination by the insurance company. If the other party accepted the $5,000 from the insurance company in settlement, the other party must have signed a Release and it would be important to see what was contained in that release. It is probable that the other party accepted that settlement as a full and final settlement and cannot seek recovery from anyone else for those damages.
