Legal Question in Insurance Law in New Jersey

Urgent! Shopping cart hit the car

I was putting the grocery in my car, and the empty shopping cart ran away from me due to the slope, and hit someone's car parked making a dent. I called the party from the store, and explained. We didn't call the insurance and exchanged phone numbers. She got two estimates for the repair, but I want to get another estimate from my mechanic. She is refusing to send the fax of the estimates and asking to go through the insurance route.

She wants the check in her name. Now, I think she is trying to get the check herself for a higher amount and then get the job done for fewer amounts and keep the difference.

- If I am willing to pay for it, is it fair on my part to ask for the estimates?

- Should I call the police next time when she meets, and get this reported?

- What are my responsibilities?

- How does the insurance co. get involved since I didn't hit by my car.

- Any other suggestions?

Re: Urgent! Shopping cart hit the car

You have the right to do nothing and let her sue you for the damage. I would repport the cliam to both you auto and homeowners ins company asap, otherwise you will not be covered. I would also report it to the shopping mall since the slope in the lot caused the runaway cart
