As a Franchise Attorney I can say this. Using someone's image is infringement. The type of infringement depends on the image. If it is a photograph, then most likely it's copyright infringement. If it is a logo, etc., then trademark or service mark infringement. Consult with a good intellectual property or franchise attorney in your area for specific advice.
