Legal Question in Employment Law in New Jersey

Can my boss do this?

An employee in my job has accused me of stealing, I proved that I didnt do it but the boss still doesnt believe me even though he hasnt fired me. Instead he has decided to take away my paid holidays, sick days and vacation days. He also has informed me that instead of paying employee price for the health ins, he is going to make me pay full price which he knows I cant afford. Is he able to do this and if not what actions do I have to take to take care of this? Please help me!

Re: Can my boss do this?

Whether your employer is legally entitled to impose discipline, and if so, under what circumstances and of what nature, depends on a number of factors which are unstated in your inquiry. These factors would include: whether there is an existing written employment agreement; if you are in a union, what the employer's contract with the union provides for; and other particular facts and circumstances.

Whether an employer may impose a sanction which negatively affects your ability to obtain health insurance is another matter, and is again dependent on the particular facts involved as well as application of relevant state, federal, and local law governing health plans.

I strongly recommend that you consult with an attorney immediately so that you can explore your legal rights, obligations, and options.
