Employment Testing

I am a new hire at a company that requires extensive testing. I passed the first test, but the second test I failed twice. HR said that if I did not pass it the third time, then I would be terminated. My boss, however, told me that he didn't pass the test the first time. He was allowed to get his failed test back, which showed the questions he missed. They are not giving me my test back. So it seems to me that what their requiring me to do is not necessary for success in the job. Are they being discriminatory because their requirements for continued employment are not necessary for success in the job?

This is unfortunate for you but as long as this is part of their normal hiring protocol then it is not discriminatory.
