Legal Question in Employment Law in New Jersey

Madicare

Hi,

I was employed by a consultancy firm last year that I resigned 1st week of Jan 2008. After I resigned I found one of my medical claims is not paid by medical insurance company. On enquiry I found that employer asked insurance company to terminate my policy effective from 12/01/2007. My question is how it is possible. My paystub shows the medical deductions till 12/28/2007. Also before taking the service I enquired the insurance provider that my policy is fine. Now the Hospital asking me to pay the due. Now I dont know what to know as being on companys group insurance I been paying my deductibles now if my employer didnt pay the money what I an do.

Please advice.

Thanks,

Amit

Re: Madicare

From the facts that you have presented, your employer had a contractual obligation to maintain your medical insurance in place for as long as you were employed. It is also likely that you are eligible for COBRA. If you have been injured by your employer's failure to keep the insurance in effect, you can sue for money damages.

My firm handles matters of this type. If I can be of further help to you, call or email.
