Release of prepared documents

Having prepared engineering documents for a client in the absence of a written contract, do I have to turn over those documents if the client has not or refuses to pay for them ?

It depends.

Obviously, a written contract outlining all of the terms and conditions of the agreement would be ideal and would tell you what you rights and duties are in this situation.

However, an oral contract or even an implied contract can be just as enforceable as a written one.

For example, is this someone you have done business with in the past? If so, how was payment handle in those instances?
