Legal Question in Legal Malpractice in New Jersey

possible patent office error

I received a patent in 1989. I have paid all maintenance fees required- the last such payment was in 1997. Recently i found an internet site showing my patent as having expired in 1997. I immediately informed my patent attorney and sent him a copy of the canceled check i had sent to him for payment. I have heard nothing more from him except that he sent me a copy of a letter he sent to patent office confirming my payment. I have recently noticed a number of products having remarkable similarities to mine. What would be most effective action for me?

Without knowing all the details it is difficult to give you an accurate response. However it would seem that your best cause of action might lie against the attorney since he apparently did not send your renewal by certified mail or other carrier that would have produced a signed receipt
