Legal Question in Medical Malpractice in New Jersey

I had total knee replacement 1/19/10. I am 57, not overweight, active in my self employed business and personal life. One week after surgery after staple removal the surgeon checked the xray and said I had "lift off". I asked what to do next, he stated "I never had that happen, you may have 5 years with that knee, but we'll keep you on a "lets see" basis. 4 weeks later, he examined my scar, mobility, not mentioning the "lift off". When I mentioned it, He stated "that happens all the time, I've done indepth studies and you'll be fine. I'm not going back in there. And, you won't have pain from that"! I've had nothing but pain, swelling. It feels like I never had it corrected. My arthritis didn't hurt this bad! The lower prosthetic device has come off the tibia, in one week!!! Do I have a case, I'm so disgusted. Second opinion surgeon said "it might last 5 years and it might not, if you have pain in 6 mos. I'd do something about it". help!!!

I agree with the other lawyer, if your doctor did the surgery wrong, you may have a case.
