Legal Question in Personal Injury in New Jersey

Brick Thrown At Car

So two bricks were thrown at our car on a Friday night. Saturday morning when we saw the damage and the bricks next to the car we called the police. The said the only thing I can do is file a police report. I have the bricks that were thrown at the car, and I know without a doubt who did this. One of the guys called friday evening to see where I would be so that they could do this act of vandalism. Could I sue for the damages. The only proof I have is the bricks (fingerprints could be pulled off of them, we didn't touch them). The cops said they can't do anything. I believe this is ridiculous shouldn't they try to figure out who commited this crime.

Re: Brick Thrown At Car

ABSOLUTELY. IT SOUNDS LIKE A CASE OF LAZY COPS. YOU NEED TO REPORT THIS TO THE SUPERIORS IN CHARGE. IF THAT FAILS GO TO THE LOCAL COUNTY PROSECUTOR'S OFFICE AND COMPLAIN TO THEM THAT THE COPS DON'T FEEL LIKE INVESTIGATING A CRIME. IF THAT FAILS, CONTACT THE ATTORNEY GENERAL'S OFFICE, THAT SHOULD GET SOME RESULTS FOR YOU. IF YOU CHARGE THEM WITH THE CRIME OF CRIMINAL MISCHIEF AND THEY ARE FOUND GUILTY, SUING FOR DAMAGES SHOULD BE EASY. YOU MAY STILL SUE THEM WITHOUT THE CHARGE, BUT THE CHARGE JUST MAKES COLLECTING THE MONEY EASIER--THEY MAY BE SENTENCED TO PAY RESTITUTION AS PART OF THE CRIMINAL CHARGE AND THAT WOULD END THE NEED FOR A CIVIL SUIT. GOOD LUCK!!!
