Legal Question in Personal Injury in New Jersey

My brother was hit by a driver and died. We were driving our motorcycles, when the driver failed to yield and stop. The driver at fault insurance company wishes to settle with his wife,however they are requesting that I (his brother), sign an agreement not to sue. I was with him at the time. I'm not sure why I have to sign when she is receiving the full amount of the drivers policy?
