Legal Question in Personal Injury in New Jersey

car accident

my car was parked in a gas station and one of the mini nj transit bus hit and ran away. I coudn't get the license plate number but whole hit and run was recorded on the store camera. police report was filed and the video tape was handed to the police dept. it happened 3 or 4 months ago. Do I have a law suit or are they liable for my damage. what should i do? no one was in the car at the time but the car was damaged badly...

Good evening,

I read the other two answers, and would like to add a couple of thoughts. You have some other options:

1. Make a claim under the uninsured motorist (hit and run) endorsement of your auto liability policy; or

2. Make a property damage claim under the NJ Tort Claims Act, if you are within 90 days from the accident; or

3. Retain a local attorney to file a motion for permission to file a late notice of claim under the NJ Tort Claims Act.

Your third option will be difficult to prevail.

Report the claim to your insurance carrier. You have no lawsuit.

Find out who hit you and bring an action in small claims court if the damage is under $5,000.00
