Legal Question in Personal Injury in New Jersey

My car was damaged in landlords parking lot. $4700 damage to exterior; insurance covers everything except $750 deductible. Landlord refuses to cover deductible, although sometimes he says he will. Should I take him to court? If so, I would also include auto rental costs (one to two weeks) when my car is in repair shop, and court costs. Please advise: is a court case worth the effort? I have moved out of apartment; landlord became aggressive with me and called me names. Or should I count myself lucky to be away from him?

That your car was in the landlord's parking lot when it was damaged is not enough to make him liable. I would need to know more about the circumstances before I could assess your claim. But if the landlord really were liable, your insurance company probably would have sued him already.
