Legal Question in Personal Injury in New Jersey

My car was parked on the street and a drunk driver hit the side and he has no insurance and a suspended license.. Is it worth taking him to court to pay my deductible??

So long as you had insurance on your car, your property damage loss is covered under that pollicy by what is known as uninsured motorist coverage. You are entitled to make a claim against your own policy for payment under that part of your coverage. You are now only making a claim under your collision coverage. Contact your insurance carrier to make this second claim.
