Legal Question in Personal Injury in New Jersey

change lawyer

I was rear ende in a car accident which happened over a month ago.I hired an attorney the next day. since then i'm going to 2 differnert doctors - psychiatrist and another one for the neck and back pain i got. the lawyer have all the info for the accident - my insurance the other driver's insurance, the police report - for over 3 weeks. The problem is even after all this time my car is still at the police station and the lawyer seams he can't get the insurance people to go and take a look at it and determine if they will reapair or declair it a total loss. i don't know if that is the usual time ( 3 weeks and more) they take to go and check the car or it's just my lawyer not taking the case seriously?mt question is :in case it's the lawyer - do i have the options to get a new one and what will be the financial impact on me for replacing him?

You have the right to replace your attorney if you are not happy with how he is handling your case. In terms of the "financial impact," that would depend in part on the terms of your retainer agreement with the attorney. Usually cases involving auto accidents involve contingency agreements with attorneys, as opposed to hourly rates. If that is the case here, switching attorneys would not affect the percentage you would get in the end. Your attorney is, however, entitled to be repaid for any costs and expenses he incurred on your behalf and in view of the fact that this is a very recent accident, any such expenses would probably not amount to very much.
