Legal Question in Personal Injury in New Jersey

is there any kind of a deferment for 2c:33-4B? is there a way that if we both do not testify for the state that they cannot charge either of us becuase they have no witnesses?

If you are both charged in the same incident that the charges emanate from, you can both decline to testify in your defense or therwise.
