Legal Question in Personal Injury in New Jersey

What to do?

my lawyer has died in the middle of my personal injury case, we reach arbitration where we rejected the offer ($30,000).but my late lawyer didn't file an appeal the defendant has filed a motion to enforce the award. isn't that enough circumtance for me to get some kind of extention

I would say that is one of the few situations which might give you relief from an arb award. The question is whether the time ran before or after the lawyer died. If it ran before, then you are stuck and you only have a malpractice claim against his estate if you wanted to recject. If it occurred after he died, then you have a reasonable argument for overturning the award. In either situation, you need to consult with an attorney.

THINK! Does it make sense you would be damaged in some way because your attorney died? Of course not, but you had an attorney, you need an attorney, so why are you asking here - go get an attorney! If you wait too ling, you WILL be stuck!
