Legal Question in Personal Injury in New Jersey

I live in ocean county Nj my 17 year old daughter fell off of playground equipment that was broke before and fixed with a piece of wood that broke took pictures of it.She got a dislocate knee from it she is on crutches for the next month and then needs physical theropy.I have medical insurance but can a case be filed for pain and suffering?

In order to bring a tort claim action against a public entity, a notice of claim must be filed with the entity within 90 days of the accident.
