How long does a person have to sue after an accident?

You are asking a very complex question and need to speak with an attorney as to your specific situation. Generally, one must file a person injury claim within two years after suffering the injury. A minor has iuntill two years after reaching eighteeen years old. There are a lot of exceptions to this rule because there is the discovery exception which tolls the running of the statute until a person discovers that the claim exists, such as discovering that there was malpractice after an extended period of time. There is also the exceiption of the defendant having left the jurisdiction for a period of time. There is also the exception of the mentally disabled person who was unable to know of the injury while mentally disabled.
