Legal Question in Personal Injury in New Jersey

NJ Limited Tort - Pedestrian hit by driver.

I was crossing the street with a green light at the designated crosswalk when the vehicle (making a left turn - also had a green light) hit me from behind. I have a number of bills that are not covered under my car insurance or medical insurance that are "my responsibility" according to both co. Can I be awarded judgement on my medical expenses in small claims court? The driver was completely at fault according to the police report.

Thank you for your inquiry. Medical expenses are recoverable if you can make a claim against the person who hit you. However, if you sustained significant injuries, please feel free to contact me or one of my partners to discuss the potential for a civil action. Blume Goldfaden Law Firm: (973)635-5400. If you did not sustain permanent significant injuries, and are simply seeking restitution through small claims for your out-of-pocket expenses, you may be able to file a small claims action.
