pending lawsuit

My husband was in a accident a few years ago. He is $46K in arrears in child support. Is it possible for me for find out if there is a pending lawsuit or if it has been settled.

There are a number to methods to determine if there is a pending lawsuit, such as going to the State judiciary website and looking up under the discovery end dates your husbands name in the likely counties that the case might be filed in. Other searches can be done for a fee through a variety of websites.

However, to the extent that your husband recovers, the law requires the attorney handling the case to do a child support search and remit payment before the debtor is paid anything except $2000. This is a statutory requirement and failure to comply can expose one to civil and criminal liability. Therefore, I would expect that if he recieves money, you will get money unless the net is less than $2000.

i have read what the other attorney Adam wrote, and he is correct.

There is a bigger problem. You do not have the $46,000 he owes you. You probably already had the Probation Department go after him, and it has not worked, he has not paid.

This much money would make a huge difference in your kids' lives and in your life. You probably do not have money to waste on lawyers. I do this work, and would like to help you.

I agree with the other two attorneys. He probably hasn't won any lawsuits, or else you would know about it. I suggest you hire an attorney to really press him on this arrears amount as it should have never gotten this out of hand.
