Legal Question in Personal Injury in New Jersey

Hi, I was recently injured at my home while doing pullups on the total gym iron pullup bar which goes behind the door frame. As I was going up, the bar came of the frame and I fell with all my weight on the right foot, leading to a Trimalleolar fracture. I just recently got home from the hospital and am unable to move, as the doctors were just able to put my bones back into place temporarily. Surgery could not be performed due to the amount of swelling around the foot. However, I will be going in next week to arrange a surgery with the orthopedic surgeon. This company assures the safety of their products. Is there any way I can make a case against this company?

Maybe is the answer. There are LOTS-o-factors to consider. I'll tell you what I tell my clients, document everything. Keep a daily journal/diary - how was your day, pain level, what hapened, what did you miss that day (going skiing with friends, family, or picking up a son, niece, grandson, etc., etc., etc.), what trearment did you get, exercises did you have to do, doctors did you visit, etc., etc. FOCUS on recovery first. You won't know for a while if you shuld even look into a law suit. Perhaps the company is going belly up, perhaps there no one else to go after for liability, perhaps in the end you will find that your actual losses combined with other factors will indicate suing is not worth while. No matter what you think anout suing for liability, the system is stacked against you. People think you can sue for anything... essentially you can, but you can not sue and win unless you have sufficient damages, sufficient proofs, sufficient liability, and a dozen other things. FIRST focus on getting the best treatment you can, asnd recovering as best you can. If you document your condition and recovery (video and pictures as well as a diary are good), you can address the legal liability in as few months. Good luck.
