Refused entry for safety by gas station attendant

In the spring of 2004, my senior year of high school, I was making a left hand turn at a light when a young man jumped in front of my car and went on my hood. I pulled into the gas station at this corner to inspect damages and such. Upon leaving my car, the man blindsided me with a punch. Upon realizing what happened I called out to the attendant to call the police, he did not. When I turned again to walk towards the store I was hit once more. I tried to open the store and found it to be locked. After asking the attendant to allow me in to call the police and having him refuse, I managed my way back into the car where my cell phone was. Police came and after nearly 2 hours I was on my way home. No medical attention. It was found that I had a concussion at the time and a completely fractured cheek bone as well as some other areas of my face. It was visually disturbing. Spent the next several months home recovering from surgery essentially missing my senior year. The man who hit me was 17 at the time and his parents had nothing. This is still in the courts papers, but I no longer know what to do. There has to be some retribution for that pain and suffering from the Hess station of police station. What is left to do?

Re: Refused entry for safety by gas station attendant

You may be able to pursue a premises liability action against the Hess station but these are difficult at best in South Carolina.

Re: Refused entry for safety by gas station attendant

You have civil and criminal remedies in such a situation. If you have no hope of getting civil remedies against teh perp, you need to push the authorities to get him on criminal charges. You may have a claim against the Hess station, as the attendant did not act reasonably under the circumstances, but you need to get an attorney (duh)! Be diligent, or nothing is going to happen.
