Legal Question in Personal Injury in New Jersey

I am being sued for personal auto injury. What should I do

Hi,

Couple of yrs back I was involved in an accident involving 3 cars. I am being sued by one of the party for personal injury and wage loss. I contacted the insurance company with which I was at that time and they asked me to fax the summons from the lawyer. I faxed them today. However they didn't give me any further info as to how it goes from there.

My question is, will the insurance company take care of it. Or should I hire another lawyer to look into it.

Any help is appreciated.

The insurance company will provide you with an attorney. They will contact you onvce they are retained.

Assuming you had a valid, typical auto insurance policy at the time of the collision, the insurance company has an obligation to provide you with defense counsel. You are of course at liberty to spend your own money to hire an attorney separately, although you should definitely tell your privately-hired attorney about the insurance policy and the insurance company lawyer. They will then communicate to discuss the case.

The main thing to be careful about with insurance companies is that they sometimes "drop the ball" in terms of referring your case out to defense counsel, and if so, they might try to blame it on you, the policy holder. Therefore, document everything in writing, keep calling the insurance company, and keep asking for the name of your attorney. When they provide this, you should initiate contact with the defense attorney. They are very often extremely busy, and may otherwise neglect your case. The squeaky wheel gets the grease.

Thanks for the inquiry. While I do not know your policy, if you have a standard policy, your insurance iwll provide a defense and an attorney. They are also obligated to pay , up to the policy limits, any judgment against you.

Typically you will not need personal counsel. However, if there were serious injuries and you ahve assets to protect, you may wish to retain one just as a precaution.

The insurance company has an obligation to make a good faith attempt to resolve the case, or they may be liable for any excess judgment. I strongly urge you to tell them to resolve the case. Do not be concerned personally about your view of hte injuries or the liability. Your job is not to save htem money but to protect your self. Therefore, encourage them to esettle the case within the policy even if you do not perceive liability. If they then force the case to trial, it is their responsibility for the excess typically.
