Legal Question in Real Estate Law in New Jersey

my brother applied for an equity loan on my name without my permission. Title company issued final policy insuring that the loan was paid off when the house was transferred to the wife. Now mortgage co is after me for the money since my brother is not paying for it. I have my own mortgage with my wife and myself. What can we do now? Please advise. AJA

You would have had to sign the mortgage documents in order for it to be in your name. If your brother forged your name, he committed fraud and there are potential criminal ramifications. If you did not sign the document, the mortgage company cannot hold you responsible. You need to contact an attorney as soon as possible to resolve this matter. I have heard a lot of crazy and stupid things that family members have done to each other.

This is one of the worst. Sorry to hear it.

You will need to fight the mortgage company, and you need a lawyer.
