Legal Question in Real Estate Law in New Jersey

Hi, I am a Landlord in NJ. My tenant moved in Sept 1, 2009 but when we all finally got to signing the 1 year lease it was dated Dec 1, 2009 to November 2010. On Sept 25, 2010 the tenant called and said they wanted to move out before this Oct. They did not give me 30 days notice. Am I entitled to keep the Security Deposit?

A lease is an agreement between two parties as any other contract. If the agreement was for a termination date of November 30, 2010, then the tenant can be held to that date. Notice is not an issue unless the lease provides for early termination with notice.
