Legal Question in Real Estate Law in New Jersey

partition of private residence

I along with my sister own a private residence and now I want to live seperately. She does not want to resolve this so I went to court and I filed in court to partition the house. My sister wants to delay this process and she did not respond and went in default for not responding to the court application. My lawyer says that New Jersey courts do not look favorably on default judgements.

So does that mean that my sister can keep playing around for years and we do not have any recourse to get this splitting of our private residence done? It has become a nightmare for both families to live under a single roof.

please advise.
