Legal Question in Sexual Harassment in New Jersey

Harrassment

I have been being harassed at my high school. I do not want to bring the matter to the aministration of the school because I do not feel that they will handle it in the proper manner. The harassment includes obscene phone calls and letters. I would like to know if there are any laws to protect me and if so, what kind of legal action may be brought upon these individuals?

Re: Sexual harrassment IN or OUT of school

You have entered dangerous country!

Are you a student or a teacher? Male or female?

Gay or straight? If a teacher, of math or phys ed?

Young or old? Married or single?

State?

What are defining as "obscene"?

Tape the phone calls (in some states this is illegal, so check), but you do want proof not only

of the phonecalls but also of the content.

Even if illegal, no DA is going to prosecute you

if the phonecalls are truly obscene (if the calls are, indeed,

obscene). In fact, the DA will use the tapes as evidence.

(There are cases on this.)

Save the letters. They, too, will be proof.

Now, to the harassment IN the school. Of what does that harassment consist?

Are there witnesses? Where? When?

Before, during, or after schoolhours?

As to legal suit: It's not worth suing an

entity -- such as a person -- without money.

If the school does not know of the harassment

and therefore cannot take action, suing the

school dept would be fruitless.

Beside being likely annoyed and having your sensitivities offended, what has been the HARM you have suffered and what have been your DAMAGES?

I'd focus more on, that is, be more concerned about,

taking defensive rather than offensive action.

You are at risk of being accused of some wrongdoing, such as enticement, encouragement, etcetera.
