Legal Question in Traffic Law in New Jersey

accident due to improperly parked truck

hi,

late one evening while driving on a new jersey highway, i smashed into the rear of a tractor trailer that was stopped in the right lane of the high way. it had no lights on. this highway did not have a shoulder. The driver claims he was stopped waiting to enter into a gas station and that he had his lights on. the police were called and an officer arrived on the scene afterwards and wrote out a police report. on the police report he marked that the truck was improperly parked but that I was inattentive. My car was damaged severly. I do not have collision insurance. Do I have any legal recourse to compensation from the truck driver or his insurance company?

Of course you do. The problem is money. You are going to have to sue the trucking company and driver. Were you injured? If so, you have a good case against them for your injuries as well. Yeah, this is going to be a tough situation and it may be difficult to get an attorney to handle this case since the issue of liablity is up in the air. However, if you were injured enough, an attorney may take it. I'm guessing you weren't injured and you only have an issue with your car. In that situation, you can probably buy two new cars for the amount of money you will need to hire an attorney. Just my guess. Feel free to give me a call if you'd like.
