Driving without Insurance

I was pulled over when the officer noticed an overdue MV inspection sticker on the windshield. I had no valid/current insurance card to present to the officer since the vehicle was not insured at the time of the incident. The officer presented me with a ticket for a court appearance on an ''expired insurance card'' which is all I had at the time of the stop. Can my licence be suspended for pleading guilty to this? Can I be fined? Will I incur any yearly insurance surcharges? (NJ, the surcharge ''capitol'' of America!) I actually received an advertisement in the mail from an attourney in the area of the violation who ''obtained my information via the F.O.A. and is offering to represent me in court for this matter. Can you provide me with an idea of large his fee will be for this matter? Should/Can I postpone the hearing until I my case properly prepaired? Any advice would be appreciated.

If you received a "No Insurance" ticket in violation of 39:6-10B, you will face a 1 year loss of license and surcharges if you plea or are found guilty. There are some defenses to this violation but the burden is on you to raise them.

However, if the officer simply gave you a ticket for "Failure to Exhibit" or "Expired Insurance Card" and it is marked as such on the ticket... for example the box for Failure to Exhibit Insurance is marked off there is no loss of license. You should at least consult with an attorney to determine how best to proceed.
