Legal Question in Traffic Law in New Jersey

Hello,

My father hired an attorney to represent him on a traffic case; re-activation of his Commercial Driver's Licence in the State of New York, to be specific. It has been two months since the attorney started working on the case and my father has not recieved confirmation on a hearing from the State of New York. This attorney continues to send letters to the wrong places and the process continues to drag week after week. He cannot provide any answers on what his plan of attack is if his letters do not work. What are my father's right if he wished to change attorney? He has gotten his livelihood taken away from him and has not been able to work for about two months now. We feel that we are tied up to the hands dealing with an incompetente attorney who is unable to get the job done.

Any assistance or guidance will be greatly appreciated.

I cannot comment on what the attorney has done or not done as I have no idea what is involved in trying to correct your father's situation. However, if you want to (or your dad wants) to hire another lawyer, then you contact another lawyer about taking charge of the case and then that lawyer will contact your current attorney for the file. Also if this is in New York, why are you posting it here? people change lawyers all the time (not always for the right reasons and sometimes the attorney they have has done nothing wrong). why not contact the lawyer first and tell him you are thinking of switching to another lawyer and meet with him to discuss the situation. At least give him the opportunity to explain what he is doing, he may be doing all that he can to rectify the situation. If he refuses to answer your questions or cannot give you a satisfactory Answer, then you can think about changing lawyers. However talk to him first. good luck
