Legal Question in Traffic Law in New Jersey

Legal and allowed??

I was pulled over for no reason. I was at a stop sign making a left turn. The cop made a right, passed me about 100 feet, made a u-turn and began to follow me. He did so for about 2 blocks. Pulled me over, asked for my info. I asked why I was being pulled over and he did not answer me. He came back and said my license was suspended. Even if he was just running the plates, the car is in my father's name, so nothing would have come up.

Did he have a right to pull me over? And he would not give me an answer as to why he pulled me over! All he did was look at me, then followed. Help-was this legal?

Re: Legal and allowed??

Based solely on what you write, it sounds like the stop may not have been legal. However, I would have to review the evidence in this case before I could give you a definite answer. And anyway, if your license is suspended the state needs to prove that you had legally sufficient knowledge of the suspension before they can convict you. I am an attorney who has handled many cases similar to yours in various courts in NJ in the past. I would like to discuss your case with you in more detail. Please contact me at your convenience. I never charge for simply talking to a person about their case. Thank you.

Re: Legal and allowed??

I really don't know what the officer did but the discovery should reveal that. It may be that your father's license was also suspended by motor vehicles by misstate. I would think that that misstate could only have happened if you and your father have the same first and last name.

Call me if you like.

Re: Legal and allowed??

Maybe the cop knew who you were or he pulled you over for one reason and then found another. You'll need an attorney to figure it all out and then fight for you. My consultations are always free, so call me at 732/247/3340 and we can discuss the case.

Good luck!
