What is the legal way to suit after accident

My car hit by the mini truck from left lane (opposite direction lane) of my driving lane. My car damaged at Left front. The police officer did not examine where was the initial hit point of accident, said to me ''you hit the truck!, you should let the truck turn''. Three days later I received a summon of ''illegal passing''. I went to court, Judge dismissed the charge on me. But the truck driver's insurance company refused to pay saying that the police report shown that I was illegal passing. Is it true as police officer said the mini-truck Could pass the double solid yellow line of the road and drive on the opposite direction lane to make a turn (If it is true, public safety will be endangered). What should I do now, from this point, I have a witness (my passenger), I also have pictures as evident. If I want to suit, who should I suit, the mini-truck driver or the owner of the mini-truck or the insurance company? Where should I suit? The court in the accident place or the Court near where I live? Please

If the accident happened in New Jersey and you live in New Jersey, then you would file a law suit in the county court house of the county where you live. If there was only damage to your car, then you have to contact your own insurance company about gettng it fixed. If yo got injured yuourself,then you would file a law suit for personal injuries against the driver and owner of the truck you had the accident with. You have posed many questions. You should sue the owner and driver of the truck that hit you. I don't know if you are filing for property damage or personal injury....so where you sue depends on the amount you are suing for. I suggest you retain an attorney to assist you.
