Legal Question in Traffic Law in New Jersey

License Suspension

I just recently found out that my license was suspened in NJ as of 9/05/04 after I had an officer there run my name for personal records to get insurance in the state of Florida. I called NJ and found out it was due to not paying insurance surcharges. I have surrendered my NJ liscense on 6/17/04 to my present Florida one and I had no idea that I was being billed for these surcharges. When I asked when the first bill was sent out they told me that it was sent out on 6/17/04 what a coincidence right? Well the thing is that they want me to pay like $300 dollars for the surcharge and restoration fees. I think this is ridiculous and they just want money from me, I also don't see why I have to pay NJ stuff when I don't even live there anymore. Is there something I can do in this matter because I definetly don't want any license suspension on my record and I don't think I should pay this money for my restoration when I don't even think I will ever have a NJ license anymore. Help, please.

You seem to be agreeing that you did not pay the insurance surcharges to New Jersey. You do indicate you were not aware of the surcharges; however, you do not provide sufficient information to determine whether the surcharges were applied in an erroneous fashion in the first place.

There may be defenses both to the surcharges and the restoration fees, but without an opportunity to look at your actual driving record, and to get more facts from you, this cannot be determined.

The mere fact that you have relocated out of New Jersey does not, however, by itself mean that you are not obligated to incur fees and charges which may have been incurred while you were located in New Jersey.

In order to take corrective action, you definitely need to hire a NJ attorney, and it will very likely cost you considerably more than $300.00 in attorney's fees. However, that may save you money in the long run if it results in clearing up your record.

If you owed the surcharges in NJ then you have to pay them. You don't say why you have surcharges, so if you have any questions about this, contact DMV to find out what they are for. Regarding payment for license restoration, you should go to the nearest DMV office in Florida where you now live and ask them what needs to be done to get your license in Florida.
