Legal Question in Traffic Law in New Jersey

I was parked by the local train station, in the shoulder lane where there are signs permitting parking, waiting to pick someone up. When leaving, there was a back up of cars in the right lane so I was not able to safely pull into the right lane to proceed. There was no one in front of me in the parking lane/shoulder so I proceeded about 100-150 feet to the jug handle and made a right turn. I was given a ticket for improper passing (NJ 39-4:85). In the time it took me to accelerate in the parking lane/shoulder, I was already at the jug handle. How far can one travel in such a parking lane/shoulder to accelerate to get back into traffic? Do I have a valid case to plead not guilty?

You are not legally allowed to drive on the shoulder like you did for any distance. What this means to you is that you do not have an actual defense to this ticket. What can be done is to go to court and try to work out a plea bargain with the prosecutor for the town where you got the ticket. This is a four point ticket, so it is fairly serious and could lead to an increase in your automobile insurance rates if it is not handled properly.
