Legal Question in Traffic Law in New Jersey

Question related to Traffic - Careless Driving Ticket for Crossing Double Yellow Line.

I was passing through Newark Avenue, Jersey City and there was a car doubled parked in front of me. There was no car coming from other side or no pedestrian crossing, hence I bypassed the car safely (though there was a double yellow line).

COP Pulled me over (and two cars in front of me) and cited Careless Driving Ticket. I would like to contest this and would really appreciate, if someone can give suggestions on what is my best defense?

I have passed this street several times and have taken a picture of similar situation ..there are always cars double parked (it's only 1 lane in both direction).

I do not have any points or my driving record is clean for last 8 years.

careless Driving carries 2 motor vehicle points so the one way to guarantee that you do not get points is to speak to the Municipal Prosecutor and see if that person is willing to offer you a no point downgrade. Obviously you want to request a Court date and if you feel that you are not guilty ask for a trial and explain your recollection of what happened to the judge. It is odd that the officer would allow vehicles to double park if the road is only one lane in each direction and not issue a ticket to the driver or owner of the car. I am guessing that there was no one in the parked car. It sounds like you may have a defense, but there are not guarantees. please feel free to call with any questions. (201)-342-5030, good luck
