Legal Question in Traffic Law in New Jersey

screwed up REALLY bad

i was speeding 100-130 mph in a 55 mph zone on the highway. i didnt notice any police or see any sirens. i drove all the way to my destination where i was pulled over. i was arrested and taking back to the police station. i have been charged with eluding the police as well as multple speeding tickets, reckless driving, unsafe lane changes and failure to stay right. it is a 2nd degree offense. my car has been impounded. my court date is next week on the 15th. can i plead not guilty to eluding police since i didnt see them? what do i do about the car? what if i cant pay all the fees? will i goto jail? do i need to have a lawyer by next week? any advice will be greatly apreciated, thank you.

There may be a chance to beat the eluding charge under the circumstances you described. I would have to read the police report to give you a definite answer as to what could be done. As to your court appearance, if it is in the municipal court then you probably do not need to appear with a lawyer for a first appearance since they wil just tell you that the case is being referred to the Superior Court due to the eluding charge. If it is in the Superior Court for a first appearance, you should probably have a lawyer with you so he can get the evidence from the State and get your defense started. Since you have your court date so quickly I imagine that your charges are now pending in municipal court but they certainly will be transferred to county court because of the seriousness of the charges.
