Speeding ticket with 6 points already

I have 6 points on my license and just received another speeding ticket doing 84 in a 65. I don't believe I was going that fast because I just entered onto a hwy. I-287 at exit 5 northbound. I didn't even make it to exit 6 when I was pulled over.

I believe this is a 4 point ticket and I'd like to take the extra surcharge, no point plea. I did use one of those about 4 years ago.

On the other hand, I'd like to challenge this ticket.

What are my chances on any of this? Thanks for any reply.

THe "I don't believe defense goes nowhere". You can use an amendment to N.J.S.A. 39:4-97.2 twice because the third time it is a four point offense.

The other possibility is a plea to a different no

pointer which involves somehow blocking traffic.

The problem is that twelve points cause an automatic license suspension and when your license is restored you still have a lot of points and any other moving violation will place your license

back on the suspended status.

You can not risk trying the case and getting four

points. You should hire an attorney because a no

pointer, depending on the court, is not so easy that you can just go in and talk to the prosecutor.

Also four points will put your insurance premium beyond the stratosphere, if it is not there already.

I agree with Mr. Moore, I practice in that area and a second 0 point ticket when you already have 6 points is not easy. I suggest you get an attorney.

If you want to fight this you have to hire a lawyer to order and review the evidence on the case. If there is no evidence to support the charge against you, then you have a chance at trial. If they do have sufficient evidence to convict you then you should accept a plea bargain, possibly a zero point ticket if it will be offered to you. If you go on your own to court then you will likely not be offered a zero point ticket.
